Grow
Strong Leaders Terms of Use
Effective date: October 8, 2026
These Terms of Use ("Terms")
govern your access to and use of the software, products, services, and websites
provided by Grow Strong Leaders ("Company," "we,"
"us," or "our"), collectively the "Services."
Please read these Terms before using the Services.
1. Acceptance and other agreements
By accessing or using the Services,
you agree to these Terms. If you do not agree, you may not access or use the
Services. If you use the Services on behalf of an organization, you represent
that you have authority to bind that organization to these Terms. In that case,
"you" and "your" refer to both you and that organization,
as applicable.
If you and the Company have entered
into a separate written agreement for particular Services, that agreement
controls to the extent it conflicts with these Terms. Otherwise, these Terms
apply.
2. Account registration and security
Some Services require an account. You
agree to provide accurate and complete registration information about yourself
and, if applicable, your organization, and to keep that information current.
You are responsible for protecting
your account credentials and for activity that you authorize through your
account. Do not share your credentials with anyone who is not authorized to use
your account. Notify us promptly if you become aware of unauthorized access or
another security breach involving your account.
3. Permitted use and prohibited conduct
You may use the Services for their
intended purposes, subject to these Terms and any applicable written license or
service agreement. You agree to use the Services lawfully and to respect the
rights of others. You may not:
- Upload, post, or transmit content
that is unlawful, threatening, abusive, harassing, defamatory, obscene,
invasive of privacy, or that infringes another person's intellectual
property or other rights.
- Harm or exploit children, or
transmit content that promotes such conduct.
- Impersonate another person or
entity, misrepresent an affiliation, or manipulate identifiers to conceal
the origin of content transmitted through the Services.
- Access accounts, systems, or data
without authorization, bypass security controls, or introduce viruses or
other malicious code.
- Interfere with or disrupt the
Services or the servers or networks supporting them.
- Use the Services in violation of
applicable laws or regulations.
4. Intellectual property and use of materials
The Company or its licensors owns the
intellectual property rights in the Services and the materials we provide,
including applicable copyrights, trademarks, and patents. Except for the rights
expressly granted in these Terms or a separate written agreement, no ownership
or intellectual property rights are transferred to you.
Subject to your compliance with these
Terms and any applicable written license or service agreement, we grant you a
limited, nonexclusive, nontransferable right to access and use the Services and
the materials made available to you for their intended purposes. This
permission does not authorize resale, public distribution, sublicensing, or use
beyond the scope of your purchase or license.
Except as expressly permitted by these
Terms, a separate written agreement, or applicable law, you may not copy,
modify, distribute, publicly perform or display, or create derivative works
from the Services or our materials without our prior written consent.
5. Privacy
Our Privacy Policy describes how we
collect, use, and disclose personal information in connection with the
Services. Please review that policy before providing personal information.
These Terms do not replace the Privacy Policy.
6. Third party websites and services
The Services may include links to
third-party websites or services. Those third parties operate independently of
the Company, and their own terms and privacy policies apply to your use of
their offerings.
We do not control, endorse, or assume
responsibility for third-party content, products, services, privacy policies,
or practices merely because we provide a link. To the fullest extent permitted
by applicable law, we are not liable for loss or damage arising from your use
of or reliance on those third-party offerings.
7. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY
APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS
AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON
INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES
WILL BE UNINTERRUPTED, ERROR FREE, OR FREE FROM VIRUSES OR OTHER MALICIOUS
CODE. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR OTHER RIGHT THAT CANNOT
LAWFULLY BE EXCLUDED.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY
APPLICABLE LAW, THE COMPANY WILL NOT BE LIABLE FOR DIRECT, INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN
CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICES. THIS INCLUDES
DAMAGES FOR LOST PROFITS, GOODWILL, USE, OR DATA, EVEN IF WE HAVE BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES.
THIS EXCLUSION DOES NOT APPLY TO
LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. NOTHING IN THESE TERMS
LIMITS ANY NONWAIVABLE RIGHTS OR REMEDIES YOU HAVE UNDER APPLICABLE LAW.
9. Events beyond our control
We are not responsible for a delay or
failure to perform our obligations to the extent caused by circumstances beyond
our reasonable control and without fault or negligence by us or our
subcontractors. Such circumstances may include natural disasters, fire, flood,
explosion, war, labor disruptions, embargoes, government actions, or widespread
internet or communications failures.
10. Indemnification
To the fullest extent permitted by
applicable law, you agree to indemnify, defend, and hold the Company harmless
from claims, liabilities, damages, losses, costs, expenses, and fees, including
reasonable attorneys' fees, arising out of or in connection with your use of
the Services or your violation of these Terms. This obligation applies only to
the extent permitted by applicable law.
11. Suspension and termination
We may terminate your access to all or
any part of the Services at any time, without notice, for any reason, including
if we believe you have violated these Terms, subject to applicable law and any
applicable separate written agreement.
When your access ends, your right to
use the affected Services ends. Provisions that by their nature are intended to
continue will survive, including intellectual property protections, warranty
disclaimers, limitations of liability, indemnification, and dispute provisions.
Termination does not override any payment, refund, or other obligations in an
applicable separate written agreement or under applicable law.
12. Changes to these Terms
We may change these Terms by posting
an updated version on our website with an updated effective date, subject to
any notice or consent required by applicable law. You agree to review these
Terms regularly. Your continued use of the Services after the updated Terms
take effect constitutes acceptance of them, to the extent permitted by
applicable law. If you disagree, you must stop using the Services. Any
applicable separate written agreement continues to govern according to its own
terms.
13. Governing law and courts
These Terms are governed by the laws
of the Commonwealth of Virginia, without regard to its conflict of laws rules,
except to the extent applicable law requires otherwise.
Subject to any nonwaivable rights
under applicable law, any legal action you bring against the Company arising
out of or relating to these Terms or the Services must be brought in a state
court of competent jurisdiction in James City County, Virginia, or, if federal
subject matter jurisdiction exists, in the United States District Court for the
Eastern District of Virginia. You consent to personal jurisdiction in those
courts.
14. Entire agreement
These Terms and any applicable
separate written agreement between you and the Company constitute the entire
agreement concerning the Services and supersede prior or contemporaneous
communications, representations, and agreements on that subject. The priority
rule in Section 1 applies to any conflict between these Terms and a separate
written agreement.
15. Severability and waiver
If a provision of these Terms is held
invalid or unenforceable, it will be severed to the extent necessary, and the
remaining provisions will remain in effect.
A waiver of a provision of these Terms
is effective only if made in writing and signed by both parties. A failure or
delay to enforce a provision does not waive the right to enforce it later.
